A New York State appellate court has ruled that an electronically signed affirmation is admissible under state court rules. The court determined that the term “subscribed” in state court rules does in fact include electronic signatures performed electronically with AssureSign Electronic Signature Software.
According to the court, electronic signatures have the same legal effect as handwritten signatures. Further, the court held that under the federal E-SIGN Act and state law, a party to a suit does not need to prove who placed the electronic signature on an affirmation.
